1. ACCEPTANCE OF TERMS

These Terms of Use (“TOU”) constitute a legally binding agreement between you and Hunting Lease App, LLC (“HLA,” “we,” “us,” or “our”), the operator of www.huntingleaseapp.com, related websites, mobile applications, updates, and associated support services (collectively, the “Service”). Hunting Lease App, LLC is a subsidiary of HLA Holdings, LLC.

Your access to and use of the Service is conditioned upon your acceptance of these TOU and any additional terms presented in connection with specific features, products, or services.

BY CLICKING “I AGREE,” CREATING AN ACCOUNT, MAKING A PURCHASE, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TOU. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICE.

IMPORTANT: THESE TOU REQUIRE BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS. PLEASE REVIEW SECTION 20 CAREFULLY.

You represent and warrant that you are:
(i) at least eighteen (18) years old or the age of majority in your jurisdiction;
(ii) legally capable of entering into a binding contract; and
(iii) not prohibited from using the Service under applicable law.

2. PRIVACY POLICY

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference. By using the Service, you consent to the collection, use, and disclosure of information as described therein.

3. GRANT OF RIGHTS; OWNERSHIP

(a) License Grant

HLA grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial use.

(b) Software Access

Any software or application components are licensed—not sold—and may be used only in object-code form within the Service.

(c) Mobile Applications

Subject to compliance with these TOU and applicable app store rules, HLA grants you a limited license to install and use the mobile applications on devices you own or control.

(d) Ownership

Except for user-submitted content, all rights, title, and interest in the Service, including all intellectual property, are owned by Hunting Lease App, LLC or its licensors.

4. REGISTRATION AND ACCOUNT SECURITY

You may browse portions of the Service without registering; however, certain features require account creation.

You agree to:

  • Provide accurate, current, and complete information

  • Maintain and update your account information

  • Maintain confidentiality of your credentials

You are responsible for all activity under your account.

5. FEES, SUBSCRIPTIONS, AND PAYMENTS

Some features require payment or subscription.

  • Fees are charged in advance

  • Subscriptions automatically renew unless canceled

  • Fees are non-refundable except as required by law

  • Pricing may change with notice

In-app purchases are governed by the applicable App Store’s terms. HLA does not control refunds processed by Apple or Google.

6. CANCELLATION

You may cancel your subscription through your account settings or applicable App Store.

Cancellation:

  • Takes effect at time of cancellation

  • Does not entitle you to a refund

  • Does not prorate fees already paid

7. USER CONTENT; COPYRIGHT

You retain ownership of content you submit (“Your Content”).
You grant HLA a perpetual, worldwide, royalty-free, sublicensable license to use Your Content in connection with the Service.

8. USER CONDUCT

You agree not to:

  • Post unlawful, misleading, abusive, or infringing content

  • Scrape, reverse engineer, or misuse the Service

  • Impersonate others

  • Violate applicable laws

HLA may remove content or terminate access at its discretion.

9. FEEDBACK

Any feedback or suggestions you provide may be used by HLA without compensation or attribution.

10. THIRD-PARTY DEALINGS

HLA is not responsible for transactions or interactions between users and third parties, including advertisers, landowners, or lease providers.

11. EXTERNAL LINKS

The Service may link to third-party sites. HLA does not endorse or control external content and is not responsible for resulting damages.

12. MODIFICATIONS AND UPDATES

HLA may modify, suspend, or discontinue the Service at any time. Updates may be installed automatically.

13. CHANGES TO TERMS

We may update these TOU at any time. Continued use after posting constitutes acceptance.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Hunting Lease App, LLC, HLA Holdings, LLC, and their affiliates from claims arising from your use of the Service or violation of these TOU.

15. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
HLA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

THE SERVICE DOES NOT CONSTITUTE A LEGAL SURVEY. USERS ARE RESPONSIBLE FOR VERIFYING PROPERTY BOUNDARIES, OWNERSHIP, AND LEGAL ACCESS.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • HLA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

  • TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $50 OR AMOUNTS PAID IN THE PRECEDING 12 MONTHS

17. ASSUMPTION OF RISK

Use of the Service may involve risks, including bodily injury or property damage. You voluntarily assume all such risks.

18. TERMINATION

HLA may terminate access at any time for violation of these TOU. Provisions that should survive termination shall do so.

19. GOVERNING LAW

These TOU are governed by the laws of the State of Texas, excluding conflict-of-law principles.

20. BINDING ARBITRATION AND CLASS ACTION WAIVER

All disputes shall be resolved by binding arbitration administered by the American Arbitration Association.
No class or representative actions are permitted.

21. NO THIRD-PARTY BENEFICIARIES

Except as expressly stated, there are no third-party beneficiaries.

22. ENTIRE AGREEMENT

These TOU constitute the entire agreement between you and Hunting Lease App, LLC.
